Renovação democrática do direito à luz da participação popular na "teoria dos princípios jurídicos"

Abstract

O artigo mostra que o desenvolvimento orgânico da sociedade mundial é ambivalente e que as relações mantidas no Mundo do Homem, da História, da Ciência e do Direito estão ambientalmente enredados às posições prévias que se adotam para proceder à estabilização dos contextos de vida e mitigar a contingência do inexplicável. Atualmente, percebe-se que o conflito entre os dois paradigmas de regulação e desenvolvimento social; quais sejam; o padrão “liberal-monetarista” e o “estatal”; desestabilizaram a confiança popular na democracia burguesa, cuja legitimação sempre foi contraditória na prática; por não prever formas institucionais de absorção da verdade do “Outro”. Procurando trazer otimismo para análise do tema, sugere-se, com respaldo em estudo de caso único, utilização estrutural da “teoria dos princípios jurídicos” enquanto “locus” para maior aproximação entre a superação democrática do marco social burguês e a compatibilização intra-dogmática das principais classes de Direito que, dotados de princípios autônomos, circulam na sociedade mundial.

The article shows that the organic development of the World society is ambiguous and that the relations maintaining in the man’s world, in the History, in the Science and in the Law, they are environmentally tangled at the previous positions adopted to proceed the stabilization of the life’s contexts and to mitigate the contingence of the inexplicable. Actually, it’s perceptible that the conflict between the two paradigms of regulation and social development; that are: the “liberal-monetary system” and the “estate system”; disestablished the popular confidence at the bourgeois’ democracy whose legitimate always was contradictory at the practice; because it doesn’t foresee institutional forms to absorb the other’s true. Looking for optimism to analyse the matter is possible to suggest, with base on stud of a uncial case to use structurally the “theory of the juridical principles” like a “locus” to the greater approximation between the democratic overcoming of the bourgeois social theory and the inter-dogmatically compatibility of the law’s kinds principals that having autonomous principles surrounding at the world society.
