Abstract:
A ciência avançou muito no campo da reprodução humana e pode proporcionar aos casais estéreis a oportunidade de terem filhos. Surge a possibilidade da utilização de material genético de um doador para ocorrer a fecundação. Com isso, temos a presença de uma terceira pessoa no processo de reprodução, o doador. A criança, destas técnicas nascida, não é filho biológico de um de seus pais, gerando conflito entre a paternidade biológica e a paternidade jurídica. O doador não pode ser conhecido, devendo permanecer no anonimato, e não pode reivindicar a paternidade. Passa-se a conceber a filiação não mais baseada nos
laços biológicos, mas sim nos laços de afetividade, a chamada “desbiologização”, em que prevalece o querer dos pais e o bem - estar da criança.
Science very advanced in the field of the reproduction human being and can provide to the barren couples to have children.
