Responsabilidade civil: de onde viemos, onde estamos e para onde vamos? Reflexões acerca dos novos paradigmas do instituto

Abstract

A presente monografia tem por objetivo fazer uma análise do instituto da Responsabilidade Civil com o intuito de perceber se ela corresponde, ou não, satisfatoriamente, às demandas atuais da sociedade. A metodologia utilizada foi a dedutiva explicativa, tendo por bases obras jurídicas, artigos e jurisprudência. No primeiro momento foi analisado como ocorreu o surgimento do instituto, a partir da investigação de suas premissas. Em seguida, enfrenta-se a problemática da função reparatória da responsabilidade civil como ferramenta única em face da constitucionalização do direito civil e do aumento quantitativo e qualitativo dos danos. Por fim, diante da sociedade de risco e da gravidade dos danos que dela decorrem, apresentar as funções punitiva e preventiva do instituto, apontando-as como soluções possíveis para as novas demandas.

This monograph aims to make an analysis of the Institute of Civil Responsibility in order to understand whether or not it corresponds adequately to the current demands of society. The methodology used was deductive explanatory, with the legal bases, articles and case law works. At first it was considered as the emergence of the institute came from the research of its premises. Then, facing the problem of remedial function of tort law as the only tool in the face of constitutionalization of the civil law and the quantitative and qualitative increase of damage. Finally, due to the risk society and the severity of the damage it entails, present the punitive and preventive functions of the institute, pointing them out as possible solutions to the new demands.
