Assédio moral no ambiente de trabalho

Abstract

O presente trabalho versa analisar os aspectos gerais do fenômeno assédio moral, aprofundando os conhecimentos no âmbito trabalhista. Embora o tema Assédio moral no ambiente de trabalho ser tão antigo quanto as próprias relações de trabalho, os estudos acerca do assunto são relativamente novos no Brasil, aumentando a frequência de casos sucessivamente. Conceitua-se sucintamente o fenômeno pela sistematização e reiteração de condutas abusivas que visam desestabilizar e excluir a vítima do ambiente comum. Serão estudadas as origens, causas, conseqüências e métodos preventivos que sirvam como estratégias capazes de evitar esse mal. O psicoterror vai totalmente de encontro com o princípio da dignidade humana, podendo originar conseqüências irreversíveis como doenças crônicas, transtornos psicológicos, ou até mesmo suicídio. Desse modo, é de vital importância, o planejamento de programas e metas suscetíveis de tutelar a saude psíquica do trabalhador. Prevenir o assédio moral representa reduzir os gastos com investimentos na saúde pública e evitar volumosas indenizações no judiciário. Ademais, necessário se faz um estudo com a distinção do assédio moral de outras agressões pontuais, sob pena de banalizar o instituto. Visto ser o assédio moral um instituto sem tutela jurídica específica em esfera Federal, serão estudas as legislações relacionadas no âmbito municipal, estadual, e federal. Bem como, uma análise de direito comparado será realizada. Por fim, pretende-se exprimir a necessidade de regulamentação desse fenômeno no nosso ordenamento jurídico. O presente estudo utilizará como metodologia, a pesquisa bibliográfica de renomados autores.

The present paper pretends to analyse general aspects from the phenomenon of harassment, Deeping the knowledge on labour context. Although the theme of harassment on work place has been as old as the own work relations, the studies around the subject are relative new in Brasil, increasing successively the frequency of new cases. The phenomenon of harassment has its concept on the systemization and reiteration of abusive conducts with the objective of destabilize and exclude the victim from normal environment. Will be studied the origin, cause, consequences and preventive methods that could became capable strategy for avoid this evil. The bullying goes totally on encounter with the principle of human dignity and can origin irreversible consequences, such as: Chomical Disease, psychological disorder or even suicide. Planning is vital. Planning programs e achievable goals to guarantee workers psychic health, Prevent harassment represents reducing cost with investments on public health and avoid high voluminous compensation on justice system. Besides, is necessary a study with distinction of harassment from other punctual aggressions, under penalty of trivialise the subject. As seen the harassment has no legal guardianship on a federal level, will be studied the related legislation on local, state and federal levels as a analyses on comparative law. At the end is pretended express the necessity of regulation of harassment on legal order. The present study will use as method the bibliography from renowned authors.
