Abstract:
O presente trabalho analisa a possibilidade de reparação de dano moral
decorrente do abandono afetivo pelo genitor. Primeiramente realiza o estudo
doutrinário da responsabilidade civil e seus desdobramentos, os requisitos para
caracterização de ato ilícito e a imputação ao ofensor do dever de indenizar. Ato
contínuo desenvolve o estudo dos princípios do direito de família constitucionais e
infraconstitucionais voltados à proteção dos menores fazendo análise da evolução
dos direitos dos filhos, comparando a tutela jurídica despendida à prole no Código
Civil de 1916 e no vigente para identificar o surgimento e evolução dos princípios da
afetividade e convivência familiar. Por final enfoca o dano moral confrontando o
posicionamento jurisprudencial do e. Superior Tribunal de Justiça e de Tribunais
Estaduais colhendo a evolução dos fundamentos jurídico-sociais no sentido de
admitir a aplicação do instituto da responsabilidade civil às relações de família e a
responsabilização do pai pelo ressarcimento de dano moral decorrente do abandono
afetivo da sua prole.
This paper analyzes the possibility of repair moral damage resulting from
emotional abandonment by father. First, realize the doctrinal study of the civil
responsibility and its consequences, the requirements for characterization of illicit act
and imputation to the offender's duty to indemnify. Subsequently develops the study
of the principles of the right to constitutional family and subconstitutional dealing with
the protection of minors making analysis of the evolution of the rights of children,
comparing the legal protection expended to offspring in the Civil Code of 1916 and in
actual to identify the emergence and evolution of the principles of affection and
interaction family. By the end focuses on the moral damage confronting the
jurisprudential positioning of Superior Court of Justice and State Courts reaping the
evolution of legal and social foundations in order to allow the application of the
institute of civil responsibility to family relationships and accountability of father for
compensation for moral damage resulting from emotional abandonment of their
offspring.
