Abstract:
As redes sociais virtuais, mediadas pela máquina e pelo sistema conhecido como
Internet, são, hoje, a maior ferramenta de comunicação, interação e desenvolvimento
interpessoal de que a sociedade dispõe. No entanto, há momentos em que a interação
virtual entre pessoas formam conflitos que têm forças para criar uma ruptura não
somente no mundo online, na rede virtual, mas também em âmbito real ou offline.
Tais conflitos, frequentemente, resultam em ilícitos que são e estão representados
através das publicações dos atores na rede, que tem o condão de ferir a honra - e
por conseguinte - a dignidade de alguém. Esse fato desencadeia e torna possível a
responsabilização do agente infrator no universo real, por meios jurídico-legais, seja por
uma responsabilização penal ou cível, a fim de resguardar direitos constitucionalmente
tutelados em nosso Estado Democrático de Direito. Este trabalho, portanto, tem a
finalidade de analisar, por meio do método hipotético-dedutivo e pesquisa bibliográfica,
as consequências oriundas dos ilícitos contra a honra de terceiros na rede social,
especificamente no site Facebook, compreendendo todo o fenômeno complexo dos
sistemas virtuais e jurídicos (e como se relacionam) em meio à sociedade na qual se
insere.
The virtual social networks mediated by the machine and by system known as the Inter-
net, are now the biggest communication tool, interaction and interpersonal development
that the society has. However, there are times when the virtual interaction between
people form conflicts that have forces to create a break not only in the online world, the
virtual network, but also in real scope or offline. Such conflicts often result in violations
that are represented by the publications of the actors in the network, which has the
power to hurt the honor - and therefore - the dignity of someone. This fact initiates and
makes it possible accountability of the offending agent in the real universe, by legal
and legal means, by a criminal or civil liability, in order to safeguard constitutionally
protected rights in our democratic state. Therefore this study aims to analyze, through
the hypothetical-deductive method and literature search, the consequences arising from
the illicit against the honor to third parties in the social network, specifically on the
Facebook site, including all the complex phenomenon of virtual and legal systems (and
how they relate) in the midst of society which it’s inserted.
