Abstract:
Os Direitos da Personalidade são irrenunciáveis e intransmissíveis, haja vista que são ferramentas para que o indivíduo possa promover a defesa de sua identidade e dignidade. Já os estudos acerca da Identidade de Gênero ampliaram a visão de indivíduo, e, com isso, trouxeram à tona a complexidade do que realmente significa ser um sujeito de direito. Neste sentido, apesar de toda uma evolução do direito em combater o preconceito, assim como a existência de teorias que desmistificam as transidentidades, estas ainda navegam à margem da sociedade. Como exemplo desta realidade, está a sua patologização pela Comunidade Médica. O objetivo geral deste trabalho está em conceituar o que é a identidade de gênero, assim como sua conexão com os direitos da personalidade. Discutir, também, os preconceitos sofridos da infância à vida adulta, assim como os problemas enfrentados por esta parcela da população que acaba por ser excluída do centro da sociedade. Assim como trazer à tona a discussão sobre as resoluções do Conselho Federal de Medicina, quando transformam transexualidade em patologia, sendo necessária toda uma burocratização para a realização da cirurgia de transgenitalização. Já o seu objetivo especifico, é responder à questão se a despatologização das identidades transexuais é viável, haja vista as consequências advindas desta mudança. A metodologia de pesquisa utilizada para a construção deste trabalho foi a bibliográfica. Afinal, os conceitos referentes ao gênero, foram encontrados na filosofia. Já os referentes aos direitos da personalidade, na doutrina jurídica brasileira. E, por fim, as informações referentes ao processo de transgenitalização, retirados de portarias do Conselho Federal de Medicina. Sendo assim, após navegar entre os conceitos filosóficos, jurídicos e médicos, conclui-se fundamental que os Direitos da Personalidade alcancem, também, as transidentidades, para que o desvio da regra padrão, não seja marginalizado. Assim como, a viabilidade da despatologização da transexualidade.

Now your specific goal is to answer the question whether depathologization of transgender identities is feasible, given the consequences resulting from this change. The methodology used for the construction of this work was the literature. After all, the concepts related to gender, were found in philosophy. Have the respect of the rights of personality, the Brazilian legal doctrine. And finally, the information regarding the reassignment process, taken from ordinances of the Federal Council of Medicine. So after navigating between the philosophical, legal and medical concepts, it is clear that the fundamental rights of Personality reach also the transidentidades, so that the standard deviation of the rule, is not marginalized. As well as the viability of depathologization of transsexuality.
