Abstract:
De certo modo a jornada atual de trabalho, que é de 44 horas semanais, não compactua com a realidade do trabalhador, ou seja, por ser muito longa não dá ao cidadão condições de gozar de seus direitos sociais, tanto os taxados pelo artigo sexto (art. 6°) da constituição federal quanto aos espalhados pelos inúmeros pactos internacionais feitos pelo Estado. Assim, a diminuição do tempo laboral traria inúmeros benefícios ao trabalhador em se tratando de Direitos humanos de segunda geração. A redução da jornada de trabalho é um tema que a princípio expressa uma discussão conturbada por posicionamentos contrários, porém, de forma mais aprofundada podemos perceber que sua concretização seria fato garantidor de outros direitos sociais. Destarte, a redução da jornada de trabalho é sem dúvidas a maneira mais coesa de se garantir os tais direitos, pois, o Estado acabaria por diminuir as taxas de desemprego, o que relativamente impulsionaria a economia e ao mesmo tempo diminuiria as doenças causadas pelo excesso de trabalho, além disso, surtiria efeitos na produtividade. De outra maneira também favoreceria não só temas ligados ao trabalho, mas também na educação, família, lazer e até segurança.
Somehow the current work journey, which is 44 hours per week, does not condone with the worker’s reality, so, for being too long it does not give the citizen conditions to enjoy his social rights, both the taxed by the sixth article of the federal constitution as the ones spread by the countless international agreements made by the State. Therefore, the reduction of the working time would bring countless benefits to the worker when it comes to the second generation of Human Rights. The reduction of the work journey is a topic that, at first, expresses a discussion troubled by opposite opinions; however, in a more detailed way we can realize that its accomplishment would be a guarantor fact of other social rights. Thus, the reduction of the work journey is undoubtedly the more coherent way to ensure that rights, because, the State would eventually reduce the unemployment rates, what relatively would boost the economy and at the same time would reduce the diseases caused by the excess of work, besides, would have effects on productivity. Otherwise it would also support not only work related issues, but also on education, family, recreation and even safety.
