O direito ao território enquanto condição para cidadania dos povos originários do Brasil

Abstract

A pesquisa trata do tema do direito dos povos originários do Brasil ao território, pela análise da atual conjuntura no país, buscando caracterizar essa relação entre “indígenas” e o poder estatal a partir da Constituição Federal de 1988. Embora tal recorte temporal, recorre-se às devidas remissões históricas, para fins de contextualizar o objeto de estudo, ao utilizar enquanto epistemologia para a investigação teórica, rompendo com concepções tradicionais, novas abordagens interdisciplinares, partindo da compreensão dos índios como “agentes”, como “sujeitos” históricos dos processos de mudanças vivenciadas. Para isso, buscando categorias metodológicas com aporte em especial na História e na Antropologia para dialogar com o Direito, bem como para fazer a crítica a este, colocando os povos indígenas enquanto protagonistas da História. Com base, na revisão bibliográfica, nas fontes documentais (leis, doutrina, jurisprudência) e nos saberes indígenas, desenvolve-se o raciocínio, do território enquanto direito fundamental para o exercício e a plena vivência dos direitos de cidadania para os povos indígenas, em sua coletividade. Tal estudo justifica-se porque os povos originários estiveram por muito tempo desde a história da colonização, na terra chamada Brasil, totalmente à margem de direitos, subalternizados em sua cidadania, e embora o período de reconhecimento com a Constituição Federal de 1988, ainda existe uma flagrante distância entre o âmbito da lei e o âmbito social, pois que vivem as populações indígenas fortes entraves para a efetivação dos direitos.

The research treats of the theme of the right of Brazilian native people to the territory, for the analysis of the current conjuncture in the country, looking for to characterize that relationship among “indigenous” and the state power starting from the Federal Constitution of 1988. Although such a temporary cutting, is fallen back upon the due historical redemptions, for purposes of contextualizing the object of study, using as epistemology for the theoretical investigation, breaking up with traditional conceptions, new interdisciplinary approaches, leaving of the understanding of the Indians as “agents”, as historical “subjects” of the processes of lived changes. For that, especially looking for methodological categories with contribution in the History and in the Anthropology to dialogue with the Right, as well as to do the critic to this, putting the indigenous people while protagonists of the History. With base, in the bibliographical revision, in the documental sources (laws, jurisprudence) and you know us indigenous, he grows the reasoning, of the territory while fundamental right for the exercise and the full existence of the citizenship rights for the indigenous people, in his collectivity. Such a study is justified because the native people were for a long time from the history of the colonization, in the called earth Brazil, totally to the margin of rights, subordinate in their citizenship, and although the recognition period with the Federal Constitution of 1988, still an instant distance exists between the extent of the law and the social extent, because that the populations strong indigenous impediments live for the effectuation of the rights.
