Abstract:
O judiciário brasileiro vem sendo influenciado fortemente por preconceitos aos princípios da livre iniciativa. Isso se dá através da atuação de magistrados que, aproveitando-se do que entendem ser o certo para a sociedade, tomam decisões que ferem as premissas que foram democraticamente construídas pela sociedade através de seus representantes eleitos. O Estado, através do judiciário, arvora-se no direito de determinar até coisas ínfimas na vida das pessoas, prejudicando um dos maiores e verdadeiros direitos que o ser humano tem: a liberdade. Para demonstrar isso, foi realizada uma pesquisa bibliográfica e jurisprudencial, com método de abordagem indutivo e de procedimento monográfico. Como resultado, constatou-se que por trás do ativismo protagonizado por muitos juízes encontra-se imbricado uma verdadeira oposição aos princípios liberais, buscando-se a realização de uma suposta justiça social a qualquer custo. O preço disso, em última análise, será a quebra do Estado Democrático de Direito.
The Brazilian judiciary has been strongly influenced by the prejudice to the principles of free enterprise. It happens through the performance of judges who, taking advantage of what they perceive to be right for society, make decisions that hurt the arguments that have been democratically constructed by society through their politicians. The State, through the judiciary, has the responsibility to determine even tiny things in people's lives, devaluing one of the best and genuine rights that human beings built: the freedom. So, explaining this idea, a bibliographic and jurisprudential survey was conducted with an inductive method of approach and monographic procedure. As a result, it realized that behind the activism of many judges exists the true opposition against the liberal principles, seeking to hold a supposed social justice at any cost. The price that, ultimately, will be the breakdown of the democratic rule of law.
