Abstract:
A “invenção” dos direitos naturais foi obra desenvolvida ao longo do século
XVII. A poderosa crítica filosófica dirigida contra as tradições consagradas
por séculos de história esteve ligada ao cenário intelectual no qual
atuaram pensadores inventivos como Hobbes, Locke e Spinoza. Na esfera
da política eles promoveram a substituição do direito divino dos reis por
concepções dessacralizantes da sociedade. Agindo assim demonstraram
que as afirmações teológicas e religiosas, até então concebidas como a
vontade de Deus, não passavam de criações humanas.
The “invention” of natural rights was developed during the 17th century.
The powerful philosophical criticism directed against the traditions laid
down by centuries of history was linked to the intellectual scenario in which
inventive philosophers such as Hobbes, Locke and Spinoza have played a
significant role. In the political field they promoted a shift from the divine
right of kings to desacralized conceptions of society. In doing so, they have
demonstrated that the religious and theological statements, thereto
conceived as God's will, were nothing but human creations.
