Abstract:
As desigualdades de gênero se mantêm vivas até os dias de hoje. A sociedade é, por si só, machista e esse aspecto se reflete em diversos aspectos, seja da vida pública como da vida privada das mulheres. O presente artigo tem como escopo discorrer acerca das desigualdades de condições no mundo carcerário, no que tange às mulheres, bem como acerca da disparidade de oportunidades e tratamento que são lançados pelo Estado às apenadas. Para isso, leva-se em consideração a análise da realidade fática sobre aspectos de oportunidade de trabalhos, educação, tratamento de saúde e maternidade em um presídio essencialmente masculino, onde existem mulheres encarceradas. O estudo de caso foi realizado na Penitenciária Estadual de Rio Grande, entre os meses de junho a novembro de 2018, e contou com entrevistas semi-estruturadas com apenadas do regime semi-aberto, Conselho da Comunidade Prisional e Ministério Público. Ademais, veremos que as condições dentro da penitenciária também seguem a lógica do sistema machista, sobrepenalizando as mulheres. Para formalização deste trabalho foi usada bibliografia histórica dos estudos de gênero e avaliados os aspectos jurídicos no que diz respeito à proteção da mulher em nosso ordenamento pátrio.
Gender inequalities remain alive to this day. Society is itself chauvinistic and this aspect is reflected in many aspects, whether of public life or the private life of women. The purpose of this article is to discuss the inequalities of conditions in the prison world, in relation to women, as well as the disparity of opportunities and treatment that the state faces in the face of grievances. To do so, we take into account the analysis of the factual reality about aspects of opportunity of work, education, health care and maternity in an essentially male prison, where women are imprisoned. The case study was carried out at the State Penitentiary of Rio Grande, between June and November of 2018, and had semi-structured interviews with the semi-open regime, the Prison Community Council and the Public Ministry. In addition, we will see that the conditions inside the penitentiary also follow the logic of the machista system, overpowering the women. To formalize this work was used a historical bibliography of the gender studies and evaluated the legal aspects with regard to the protection of women in our country order.
