Abstract:
Abordam-se no presente as diversas ações ao alcance dos sindicatos para a defesa das categorias laborais. Sem pretender esgotar o assunto analisam-se os dissídios coletivos, as ações de cumprimento, o protesto
judicial para asseguramento da data base, a ação para anulação de cláusulas convencionais, a ação coletiva e a ação civil pública. Ao final, no tocante às ações coletivas, analisou-se a diferença entre estas e as outras ações estudadas. Verificou-se, quando o assunto suscitou alguma dúvida, os entendimentos jurisprudenciais, trazendo-se decisões do Tribunal Superior do Trabalho e dos Tribunais Regionais do Trabalho, em especial do Tribunal Regional do Trabalho da Quarta Região.
It is approached in this diverse actions within the reach of unions for the protection of labor categories. Without intending to exhaust the subject analyzes the collective bargaining agreements, the enforcement
actions, the protest proceedings for securing the base date, the action for annulment of conventional terms, collective action and class actions.
Finally, with respect to collective actions, we analyzed the difference between these and other actions studied. It was found when the issue raised questions, the jurisprudential understanding, bringing to decisions of the Superior Court of Labour and Regional Labour Courts, in particular the Regional Labor Court for the Fourth Region.
