Abstract:
O presente artigo propõe-se a analisar o pluralismo jurídico dentro do campo das grandes mudanças produzidas pela globalização neoliberal, que amplia a exclusão social e que também produz novas subjetividades rebeldes, canalizadas por novos movimentos sociais e políticos. O texto procura compreender a possível interligação do pluralismo jurídico comunitário participativo e as oportunidades de reorganização do espaço público abertas, em virtude da constituição de processos plurais de contestação social disseminados na América Latina. Tais mudanças acompanham o processo de descolonização imperial e a construção de uma base epistemológica do Sul com a redefinição do papel do Estado, a construção de uma economia solidária e alternativa materialmente anticapitalista, assim como compreende a criação da práxis dos novos sujeitos coletivos de classe edificadores e potencializadores da ação das comunidades de vítimas latino-americanas, por meio da luta contra o sistema de opressão capitalista periférico neocolonial.
This article proposes to examine the legal pluralism within the field of major changes produced by neoliberal globalization, which increases the social exclusion and also produces new subjectivities rebel diverted by new social and political movements. The text seeks to understand the possible
interconnection of the Community legal pluralism and participatory opportunities for the reorganization of public open space, due to the formation of plural processes of social contestation widespread in Latin America. These changes accompany the process of decolonization and imperial building a
basic epistemological South with the redefined role of the state, the construction of a social economy and alternative anti-material, and includes the creation of the praxis of new collective subjects of class builders potentiators of the action and communities of Latin American victims, through the struggle against the system of capitalist oppression.
