Abstract:
As profundas modificações na relação médico-paciente acarretaram a medicalização da prática médica, na qual o enfermo é concebido como um consumidor, muitas vezes, irracional dos serviços de saúde, e o profissional como sujeito descompromissado com o bem-estar do doente. Desse modo, o objetivo do trabalho é apresentar os problemas que envolvem os cuidados com a saúde, sua evolução para mero objeto de consumo e a judicialização do seu acesso. Nesse sentido, é notório que o desenvolvimento técnico-científico e a iminência de riscos decorrentes dele influenciarem a humanidade a
produzir uma ética voltada para a civilização e o mercado biotecnológico, a fim de abrigar a dignidade da pessoa humana dos excessos do biopoder, originado da grande transformação da medicina, gerada pelos avanços científicos na seara de novas
terapias e medicamentos.
Considerable changes in the doctor-patient relation caused the medicalization of medical practice, in which the infirm is seen as a consumer of health care, most of the times an irrational one, and the professional is considered a subject who is not committed to the
welfare of the sick. Thus, the aim of this paper is at showing the problems that involve health care, its evolution as a consumption matter, and the judicialization of the access to it. Therefore, it is evident that the technical and scientific development and the immanence of risks imposed by it have influenced the humanity to produce ethics for the civilization and the biotechnological market. As a result, the dignity of human kind is protected from the excess of biopower caused by the great change in medicine created by scientific advances in the field of new therapies and medicines.
