Abstract:
Neste artigo tem-se por finalidade analisar alguns aspectos da construção teórica de Samuel Pufendorf acerca da legitimação do Estado Civil. Partindo de uma noção racional sobre os deveres do homem, o autor descreve um Estado de Natureza marcado pelo impulso à sociabilidade. Contudo, a inexistência de um poder superior não garante a convivência pacífica entre os sujeitos. Nesse sentido, o trabalho analisará, dentro da perspectiva de Pufendorf, a causa ou a tendência das comunidades políticas formarem o Estado.
The paper aims to analyze some aspects of the theoretic construction of Samuel Pufendorf concerning the legitimation of Civil State. Starting from a rational notion about de duties of man, the author describes a Natural State marked by the impulse of sociability. Nevertheless, in this context, the inexistence of a common supreme power is not able to guarantee the peaceful coexistence amongst men. Therefore, the article will analyze, through Pufendorf ’s perspective, the cause or tendency to the political communities in establishing the State.
