Abstract:
A guarda compartilhada foi instituída pela Lei 11.698 de junho de 2008. Embora
desde o princípio o objetivo da instituição da modalidade da guarda conjunta
fosse garantir aos filhos de pais separados o direito à convivência com ambos
os pais após a ruptura conjugal; na prática, pouco se viu isso acontecer. Com o
advento da Lei 13.058 de 2014, e a consequente modificação no texto legal,
buscou-se efetivar a aplicabilidade da guarda compartilhada. Com a
obrigatoriedade da aplicação da guarda compartilhada e a consequente
responsabilização conjunta diante dos direitos e deveres concernentes a
garantir o desenvolvimento da prole, a presente modalidade vem assumindo
um importante papel. Nesse âmbito, o presente estudo busca ressaltar a
importância da convivência familiar para o desenvolvimento físico, moral,
intelectual, bem como psicológico do indivíduo, destacando os impactos
positivos e negativos da modalidade na vida da criança e do adolescente.
The present study will analyse the Right to Identity using conceptualizations
within the areas of sociology, anthropology, psychology and law. Will initially be
analyzed the emergence of the state of rights from the modernity and the subsequent
construction of identity in the national Brazilian State since the proclamation of
independence and their reflections in the Federal Constitution of 1988. Then, will be
made brief explanatory about modernity and its effects in the construction of personal
identity. After, it will be given to the construction of the right to identity and its offshoot
from the rights of personality and its historical bias, practical and legal, as well as
consideration will be given to the principle of the dignity of the human person and as
their existence is able to influence the promulgation of sparse laws, the adoption of
affirmative actions and public policies in Brazil with the objective of reducing cases of
racial discrimination and the international sphere, the Declarations of the UN, which
have the purpose of eradication of all forms of discrimination.
