Abstract:
O presente estudo visa a buscar uma barreira de contenção ao hegemônico discurso neoliberal, bem como analisar as consequências desse sobre os direitos sociais já implementados no plano constitucional e infraconstitucional brasileiro, especialmente no que tange aos benefícios do Regime Geral de Previdência Social. Assim, através de pesquisa bibliográfica e documental, primeiramente, é abordada a história da Previdência Social no Brasil - uma história de exclusão, avanços e retrocessos sociais -, apresentando-se um breve panorama da evolução da legislação previdenciária referente ao Regime Geral de Previdência Social, desde as suas origens até a promulgação da CF/88, bem como as conquistas obtidas através desta e as reformas operadas posteriormente. No Brasil, o constituinte originário encontrou no direito à Seguridade Social o meio para reduzir as desigualdades sociais e proporcionar uma sociedade mais justa e solidária, contudo, conforme o presente trabalho demonstra, os direitos previdenciários têm sido denegados de forma perversa, através de sistemáticas reformas, as quais estão pautadas pela indução das ideias neoliberais. O movimento neoliberal é analisado através da obra de seus principais representantes: Ludwig Von Mises, Milton Friedman e Friedrich August Von Hayek. Da mesma forma, é analisada a influência do movimento neoliberal na onda reformista que atingiu a América Latina, bem como é examinado o caso do Chile, considerado paradigmático. Por fim, a pesquisadora traz elementos que subsidiem o debate em torno das políticas sociais e da noção de proteção social, especialmente as relativas aos benefícios do RPGS no Brasil, diante do cenário reformista, tais como a financeirização da previdência complementar, o suposto deficit da Previdência Social, as renúncias fiscais, os parcelamentos e a Desvinculação das Receitas da União (DRU), os quais espelham a forma como são manejados os recursos da Seguridade Social. Assim, diante do cenário político atual que visa a reformas sucessivas - o que de certa forma foi uma constante em nosso país desde a promulgação da CF/88 - serão trazidos instrumentos e dados para uma ponderação acerca dos caminhos que vêm sendo sinalizados para o RGPS.
The following research aims to find a way to contain the hegemonic neoliberal discourse, as well as the consequences of this discourse on social rights already implemented in the brazilian constitutional and infraconstitutional plan, especially with regard to the benefits of the General Social Security System. Thus, through a bibliographical and documentary research, first, is told the history of Social Security in Brazil - a history of exclusion, advances and social regression - presenting a brief overview of the social security laws Evolution referring to the General Social Security System in Brazil, from its origins until the enactment of the CF/88, the advances obtained through it and the reforms that were subsequently carried out. In Brazil, the original constituent found in the right of Social Security the means to reduce social inequalities and to provide a more just and solidary society, however, as this reasearch demonstrates, social security rights have been denied perversely, through systematic reforms, which are based on the induction of neoliberal ideas, that are also studied in this work. The neoliberal movement is analyzed through the work of its main representatives: Ludwig von Mises, Milton Friedman and Friedrich August Von Hayek. It also analyzes the influence of the neoliberal movement on the reformist tendency that affected Latin America, as well as examining the case of Chile, considered paradigmatic. Finally, the researcher brings elements that subsidize the debate around social policies and the notion of social protection, especially when related to the benefits of RPGS in Brazil, in the reformist scenario, such as the financialisation of supplementary social security, the alleged Social Security deficit, the tax waivers, the installments and the Unbundling of Union Revenues (DRU), that reflect the way how the Social Security funds are handled. Thus, according to the current political scenario of successive reforms - which has been a constant in our country since the enactment of CF/88 - mechanisms and data will be brought to a consideration of the paths that have been signaled to the RGPS.
