Abstract:
Esta pesquisa tem como objetivo analisar o tema conjugalidade homoafetiva, a partir da decisão do Supremo Tribunal Federal (ADI 4.277), que reconheceu as uniões homoafetivas, estendendo o debate para averiguar a possibilidade de acesso também ao casamento. O estudo, de abordagem qualitativa, apoia-se nos escritos de Foucault (2014), Butler (2013) e Louro (2014) com a finalidade de discutir as interfaces entre sexualidade, gênero e identidade na contemporaneidade. Apoia-se na análise de Lôbo (2010), cujo propósito é analisar as uniões homoafetivas como entidades familiares. Essas análises se acentuam na medida em que as definições dos termos gênero, sexualidade e identidade se opõem a forma de pensar os padrões binários de gênero, que interceptam nossas relações políticas, culturais e sociais. Questiona-se se, o reconhecimento da união estável e das garantias previstas constitucionalmente, destacando o acesso à justiça e a efetividade das inovações legais sobre a união estável entre casais do mesmo sexo e o casamento, uma vez cumpridos os requisitos legais, vem tendo o efeito positivo, ou se, ao contrário, não vem surtindo o efeito pretendido pelo Supremo (STF). Além disso, pretende-se analisar a fundamentação do Tribunal de Justiça do Rio Grande do Sul (TJRS) no que tange a constatação dos referidos institutos - união homoafetiva e casamento -, constatando, assim, o conteúdo das demandas judiciais, visando o reconhecimento legal da união homoafetiva. Portanto é através da decisão referida pelo Supremo Tribunal Federal (ADI 4.277) que verificar-se-á os argumentos proferidos pelo Tribunal de Justiça do Rio Grande do Sul se tais casais possuem os direitos garantidos constitucionalmente. Assim, busca-se com o presente estudo, entrelaçar a percepção dos casais homoafetivos com os posicionamentos jurídicos, envolvendo a união entre casais do mesmo sexo, casamento e acesso à justiça, tendo em conta a construção política dos corpos que articulam sexualidade, gênero e identidade.
The purpose of this research is to analyze homoaffective conjugality, based on the decision of the Federal Supreme Court (ADI 4.277), which recognized the homoaffective unions, extending the discussion to investigate the possibility of access to marriage. The study, based on a qualitative approach, supports itself on the writings of Foucault (2014), Butler (2013) and Louro (2014) in order to discuss the interfaces between sexuality, gender and identity in contemporary times. It is based on the analysis of Lôbo (2010), which purpose is to analyze homoaffective unions as family entities. These analyzes are accentuated as the definitions of the terms gender, sexuality, and identity oppose the way of thinking about binary patterns of gender that intercept our political, cultural, and social relations. It is questioned whether recognition of the stable union and the constitutionally guaranteed, highlighting the access to justice and the effectiveness of legal innovations about stable union between same-sex couples and marriage, once the legal requirements have been met, has been positive effect, or if, on the other hand, it has not had the desired effect of the Supreme (STF). In addition, it is intended to analyze the reasoning of the Court of Justice of Rio Grande do Sul (TJRS) regarding the findings of these institutes - homoafetive union and marriage -, thus verifying the speeches of the lawsuits, aiming at legal recognition of homoaffective union. Therefore it is through the decision referred by the Federal Supreme Court (ADI 4.277) that it will be verified in the speeches given by the Court of Justice of Rio Grande do Sul if the couples have the rights guaranteed constitutionally. Thus, we seek with this study, interweave the perception of homosexual couples with legal positions, involving the union between same sex couples, marriage and access to justice, accounting the political construction of bodies that articulate sexuality, gender and identity.
