Abstract:
A presente dissertação de mestrado tem por objetivo geral investigar o fenômeno do greening do Sistema Interamericano de Direitos Humanos partindo da possibilidade de inserção dos danos causados por derramamento de petróleo no rol de violações passíveis de judicialização no Sistema. Para isso, o trabalho parte do desenvolvimento da indústria petrolífera e os desafios que esse setor econômico enfrenta no que diz respeito às violações de direitos humanos, em especial do direito humano ao meio ambiente sadio. Em seguida, a análise recai sob a evolução histórica do direito ambiental internacional e dos direitos humanos, explorando o desenvolvimento da concepção do direito ambiental como um direito humano. Por último, abordará o Sistema Interamericano de Direitos Humanos, sua estrutura, marcos normativos e vias de acesso. Será estudada a proteção do direito ao meio ambiente por via reflexa, forma comumente utilizada para alcançar a proteção do direito ao meio ambiente no Sistema e a evolução da abordagem das questões relativas aos direitos econômicos, sociais, culturais e, principalmente, ambientais nos últimos anos. Diante desse cenário, através da análise de algumas jurisprudências da Corte Interamericana de Direitos Humanos, a questão da justiciabilidade desses direitos será examinada. Constata-se, por fim, que o Direito ao Meio Ambiente é um Direito Humano e assim deve ser assegurado. Dessa forma, os eventos envolvendo derramamento de petróleo nos mares e oceanos são uma clara violação do direito humano ao meio ambiente sadio, portanto, podem e devem ser objetos autônomos de apreciação do Sistema Interamericano de Direitos Humanos (quando a resposta interna não for eficaz). Percebe-se, portanto, a necessidade da constante revisão, construção e ressignificação dos direitos humanos através da ideia de que a sua salvaguarda não reside só nos documentos nem nas instituições, mas também, e especialmente, no sentido de dignidade. A pesquisa se utiliza da técnica de revisão bibliográfica, a partir da análise de legislações, textos, livros, artigos científicos, relatórios, documentos oficiais, instrumentos jurídicos internacionais e jurisprudências.
This master's dissertation aims to investigate the phenomenon of greening of the Inter-American Human Rights System starting from the possibility of inserting the damage caused by oil spills in the list of violations subject to judicialization in the System. To this end, the work starts with the development of the oil industry and the challenges that this economic sector faces with regard to human rights violations, especially the human right to a healthy environment. The analysis then looks at the historical evolution of international environmental law and human rights, exploring the development of the concept of environmental law as a human right. Finally, it will address the Inter-American System of Human Rights, its structure, regulatory frameworks and access routes. The protection of the right to the environment will be studied through reflection, a form commonly used to achieve the protection of the right to the environment in the System and the evolution of the approach to issues related to economic, social, cultural and, especially, environmental rights in recent years. Given this scenario, through the analysis of some jurisprudence of the Inter-American Court of Human Rights, the question of the justiciability of these rights will be examined. Finally, it is noted that the Right to the Environment is a human right and should therefore be ensured. Thus, events involving oil spills in the seas and oceans are a clear violation of the human right to a healthy environment, and therefore can and should be autonomous object of appreciation of the Inter-American Human Rights System (when the internal response is not effective). The need for the constant review, construction and re-signification of human rights is therefore perceived through the idea that its safeguarding lies not only in documents and institutions, but also, and especially, in the sense of dignity. The research uses the technique of bibliographic review, from the analysis of legislation, texts, books, scientific articles, reports, official documents, international legal instruments and jurisprudence.
