Abstract:
Esta Dissertação tem como escopo analisar a dicotomia que acomete o corpo feminino: por um lado, é fonte de conhecimento, tendo resultado em disposições legais ao longo do tempo; por outro, tem impedido a concretização de novos direitos no Brasil. Para isso, foi baseada em pesquisa exploratório-descritiva, através do método bibliográfico-documental, tendo como suporte teórico-metodológico os conceitos de poder e biopoder de Michel Foucault, e os conceitos de empoderamento, libertação e emancipação da Bioética de Intervenção. A escolha do tema pauta-se na insuficiência de leis protetivas e de políticas públicas no tocante ao assunto, ou seja, na ineficácia das leis existentes e da inexistência de leis eficazes, tendo como pressuposto o reconhecimento da falta de autonomia do corpo feminino enquanto violação dos direitos humanos e do princípio da dignidade da pessoa humana. Espera-se que esta proposta investigativa possa contribuir com a consolidação dos direitos das mulheres no Brasil, através de sua inclusão social no campo da saúde pública, na busca pela justiça de gênero e, por conseguinte, por justiça social.
This study analysis the dichotomy of the feminine body: on the one hand, its source of knowledge, resulting in legal rules over time; on the other hand, has prevented the new rights realization in Brazil. In this regard, it was based on the logical-deductive through the method of bibliographical research, having as the theorical and methodological support the concepts of power and biopower in Michel Foucault, and the concepts of empowerment, libertation and emancipation in Intervention Bioethics. The choice of the theme is related to the insufficient protective legislation, in other words, to the ineffectiveness of the existing rules and the lack of effective rules, based on the assumption the absence of the feminine body autonomy as human rights violation and the principle of the dignity of the human person. It is expected that this investigative proposal can contribute towards the consolidation of womens rights in Brazil, through their social inclusion in the field of public health, in the search for the gender equality, and, consequently, for the social justice.
