Abstract:
A relevância jurídica do bem jurídico meio ambiente, tutelado pela
disciplina de Direito Ambiental, justifica a necessidade de que este bem
seja plenamente protegido. Assim, o artigo 225, parágrafo 3º, da
Constituição Federal, e o artigo 3º da Lei 9.605/95, preveem a tríplice
responsabilidade das pessoas físicas e jurídicas: responsabilidade
administrativa, civil e penal por danos causados ao meio ambiente.
The legal relevancy of the environment, protected by the discipline of
environmental law, justifies the need of its full protection. So, the article
225, paragraph 3º, of the Federal Constitution, and the article 3 of the Law
9.605/95, predict the triple responsibility of individual and corporation:
administrative, civil and criminal responsibility for damages caused to the
environment.
