Ilusão ou implementação do terceiro objetivo da convenção sobre diversidade biológica?

Abstract

O Acesso aos Recursos Genéticos e Partilha dos Benefícios que advêm da sua utilização (ABS), terceiro objetivo da Convenção sobre Diversidade Biológica (CDB), tem sido negligenciado ao longo dos últimos 20 anos, resultando num aumento sem precedentes da biopirataria, com consequências negativas que afetam desde a conservação da biodiversidade até ao crescimento económico de um país. Em 2010, foi adotado o Protocolo de Nagoia sobre ABS, visando operacionalizar este objetivo da CDB. Entretanto poucos foram os avanços nestes dois últimos anos, e o Protocolo de Nagoia ainda não entrou em vigor. Assim, neste artigo, a partir de uma análise documental e da literatura, identifica-se as lacunas existentes no Protocolo e sugere-se soluções para colmatá-las.

The Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization (ABS), the third objective of the Convention on Biological Diversity (CBD), has been neglected over the past 20 years, resulting in an unprecedented increase in biopiratry with negative impacts not only on a country’s biodiversity preservation but also on its economic growth. The Nagoya Protocol on ABS was adopted in 2010 in order to operationalize this goal proposed by the CBD. However, since there have been few advances over the last two years, the Nagoya Protocol has not been officially applied yet. Therefore, this paper aims at identifying gaps in the Protocol and at suggesting solutions to fulfill them in the light of a document analysis and a literature review.
