Imagens da justiça e educação jurídica na contemporaneidade

Abstract

Na contemporaneidade pesquisas com fontes visuais têm possibilitado dialogar com o mundo da escrita, fala-se, inclusive, em uma virada imagética para defender as questões emergentes suscitadas pelos estudos no campo iconológico. A presente investigação de abordagem qualitativa problematiza a educação jurídica, o currículo do curso de Direito e a pedagogia jurídica utilizando a interpretação de imagens como referencial teórico-metodológico, com ênfase no Método Documentário de Ralf Bohnsack. Entende-se que a produção de imagens da justiça por alunos ingressantes pode potencializar importantes reflexões no ensino do direito, principalmente as que se referem às questões culturais, sociais e econômicas. Este texto focaliza parte dos dados de uma pesquisa mais ampla cujo objetivo é analisar imagens da justiça nos contextos de três cursos de Direito do sul do Brasil, como elementos de análise do currículo do curso. Para o presente estudo utilizou-se imagens produzidas por acadêmicos ingressantes de um destes cursos, pretendendo indagar através das imagens como estudantes produzem registros visuais sobre a justiça. Ao convidar acadêmicos iniciantes no direito a descrever/desenhar imagens da justiça e, logo a seguir, remeter um significado ou uma palavra que a represente, pretende-se questionar como estes estudantes visualizam a justiça, vale dizer, que percepções produzem sobre a justiça e o direito. Quando se analisa imagens elaboradas através de uma interação de base etnográfica, potencializam-se as relações entre sujeitos e entre suas representações de mundo, produz-se, desta forma, conhecimento sobre o outro e sobre si mesmo, e, sobretudo, reflexiona-se sobre a justiça. Nesta investigação, em que em um conjunto de imagens produzidas aparece a figura de uma balança, muitas delas em desequilíbrio, indaga-se que representações estes alunos possuem da igualdade e do próprio direito. Defende-se, assim, que a análise das imagens da justiça produzidas pelos estudantes pode contribuir para suscitar reflexões sobre a educação jurídica na contemporaneidade.

Research on visual sources has enabled the establishment of a dialog with the world of writing in the contemporary world; a pictorial turn has been even mentioned that would support emerging issues evoked by studies in the iconological field. This investigation has a qualitative approach and aims to discuss legal education, the law program curriculum and legal pedagogy through the use of image interpretation as a theoretical and methodological framework, with an emphasis on Ralph Bohnsack‟s Documentary Method. The production of images of justice by freshman students is thought to have stimulated relevant reflections on the teaching of Law, mainly those referring to cultural, social and economic issues. This paper focuses on part of the results of a larger research project which aims at analyzing images of justice within the context of three major Law programs in southern Brazil. The present study made use of images created by freshman law students from one of these institutions with the intention of questioning how these students create visual records of justice through images. Upon inviting freshman students in the Law program to describe / draw images of justice and jointly refer to a representative meaning or word, we intended to question how these students view justice, that is, their perceptions of justice and law. When images produced by the interaction of an ethnographic basis are analyzed, the representations between subjects and their representations of the world are strengthened, thus producing information on each other and on oneself and, above all, enabling a reflection on justice. This study, in which many of the images showed the drawing of the scales of justice, several of which unbalanced, questions the students‟ representations of equality and law itself. The analysis of images of justice created by students, therefore, can contribute to the debate on legal education in the modern world.
