Abstract:
Esta dissertação intitulada "A Educação Ambiental na atuação da PromotoriaEspecializada do Ministério Público Estadual do Rio Grande-RS: um estudo de casoa partir de termos de ajustamento de conduta referentes à poluição atmosférica".Apoluição do ar advinda, em grande parte, das indústrias de fertilizantes, é umaproblemática recorrente e que atinge um número elevado de pessoas que vivem noscentros urbanos. Nesse sentido, esta pesquisa foi elaborada com base na EducaçãoAmbiental Crítica e buscou investigar de que forma a atuação do MPE/RS, a partirdos termos de ajustamento de conduta, contribui para a redução da poluiçãoatmosférica no Município do Rio Grande, causada em grande parte, pelas indústriasde fertilizantes. Para atingir o objetivo proposto foi necessário compreender asituação da poluição atmosférica no Município, bem como analisar aspectosrelevantes sobre o licenciamento ambiental. Ainda, pesquisaram-se os termosfirmados entre o Ministério Público e as empresas Yara Brasil e TIMAC Agro. Ametodologia qualitativa adotada foi o estudo de caso com a técnica de pesquisa deanálise documental. Para analisar os termos de ajustamento de conduta utilizou-se aanálise de conteúdo. A partir das análises obtidas, os resultados indicaram que oMunicípio, descrito como zona de sacrifício, é um local de severa injustiça ambiental,principalmente no que se refere às comunidades do entorno do Distrito Industrial,onde estão localizadas empresas de fertilizantes, às quais são responsáveis pordanos socioambientais. Do mesmo modo, constatou-se que há inúmeras fragilidadesno procedimento administrativo do licenciamento ambiental, sendo que, não sãotodas as empresas que possuem Programas de Educação Ambiental, pois seelaboras sem ações de Educação Ambiental Crítica, estas, auxiliariam natransformação cultural da empresa e, a partir disso, em mudanças efetivas quanto àpoluição do ar. Ainda, reconheceu-se que os termos de ajustamento de condutafirmados, almejam evitar ou corrigir danos ambientais, porém, não são embasadosnos preceitos da Educação Ambiental Crítica, pois não problematizamsuficientemente a realidade e não auxiliam na busca pela justiça ambiental,transformação social e bem-estar coletivo.
This masters thesis calls "Environmental Education in the performance of ProsecutorSpecialized of State Public from Rio Grande - RS: a case of studying to start fromterms of adjustment of conduct regarding the air pollution". It is relevant because thepollution of the air is resulting of a great part of the industries of fertilizers. This is arecurring problem that it reaches, in unequal way, a high number of people. It wasinvestigated that it forms the performance of the State Public Prosecution startingfrom the terms of adjustment of conduct and based on the critical EnvironmentalEducation. It contributes to reduce the air pollution in Rio Grande city. Then, theobjectives were structured from way to understand the situation of the air pollution inthe Rio Grande city transversalized for the critical Environmental Education as wellas to analyze relevant aspects on the environmental license. Still, to research on theState Public Prosecution and the terms with the companies Yara Brasil and TIMACAgro. This researching had as qualitative methodological approach, the case ofstudying, in that the technique of researching of documental analysis was used. Itwas used the Analysis of Content to analyze the terms. In this perspective, theresults was collected indicated that Rio Grande city, described as sacrifice zone, it isa place of severe environmental injustice. Primarily,it was referred to the communitiesof the environment of the Industrial District where they are located companies offertilizers which are responsible for damages socio environmental. Likewise, it wasverified that there are many weakness in the administrative procedure of theenvironmental license. And they are not all of the companies that possess Programsof Environmental Education which if they counted with actions of criticalEnvironmental Education they could help in the cultural transformation of thecompany. Besides, starting from that, in changes in what refers to the air pollution.Still, it was recognized that the executed terms that they aim to avoid or to correctenvironmental damages. Then, they are not based in the precepts of the criticalEnvironmental Education, since, they dont problematize the reality sufficiently andthey dont help in searching for the social transformation, so that can demandenvironmental justice and collective well-being.Environmental Education.
