Abstract:
O presente artigo resgata as balizas constitucionais que norteiam a carreira docente federal e a seguir examina, à luz destas, as normas infraconstitucionais que norteiam a carreira docente federal atualmente. Faz inicialmente o resgate dos dispositivos constitucionais pertinentes, notadamente os que regulam a administração pública e os servidores públicos, assim como a própria educação superior. A seguir, analisa o denominado “PUCRCE”, norma que instituiu a carreira de professor federal no Brasil, seguindo a análise pelas demais normas que disciplinaram a carreira nos últimos 25 anos, abrangendo aproximadamente uma dezena de dispositivos normativos.
Culmina com a demonstração das inconstitucionalidades
encontradas nesses dispositivos, entre as quais a
inconstitucionalidade formal do próprio “PUCRCE”.
The present paper rescues the constitucional landmarks that guides the professor’s federal career and then examines, in view of this, the infra-constitucional rules which guides the professor’s federal career nowadays. At first it rescues the relevant constitucional mechanisms, mostly those that control the public administration and the public functionary, as well as higher education itself. Following, it analyzes the called “PUCRCE”, norm that established the professor’s federal career in Brazil, following the analysis by the other rules that had disciplined the career over the past 25 years, covering nearest ten normative devices. It culminates in a demonstration of the unconstitutionalities found in those devices, including the formal unconstitutionality of the “PUCRCE” itself.
