Abstract:
O presente trabalho se propõe ao resgate de uma pretensão que se encontrava no imaginário iluminista do império, qual seja a ideia de que a política educacional poderia reservar espaço estratégico, no nível do ensino superior, por meio das Faculdades de Direito, para capacitar os que pretendessem trabalhar para no serviço
público e busca verificar se tal pretensão poderia materializar-se no contexto contemporâneo, tendo por foco a análise das normas que regem o ensino superior hodiernamente. Para tanto, desdobra-se em três distintos momentos: inicialmente se busca resgatar, no universo normativo do império, onde e como se manifestaram estas ideias chave. A seguir, busca demonstrar as configurações básicas normativas que atualmente norteiam o ensino superior brasileiro, pretendendo demonstrar que a realidade jurídica contemporânea comporta, com peculiares variações, a materialização daquelas pretensões. Por derradeiro conclui com uma breve reflexão sobre a necessidade atual de um curso específico de graduação para qualificação dos agentes públicos em geral, trazendo algumas das características que a respectiva proposta pedagógica poderia assumir.
This paper aims to the rescue of a pretension that was the Illuminist imaginary empire, namely the idea that educational policy could book strategic space in higher education through the Faculties of Law, for enable those who wishing to work in public service and verifies whether such intention could materialize in the contemporary context, with the focus on the analysis of the rules governing higher education in our times. Therefore, unfolds in three distinct stages: first, seeks to rescue in the imperial law, where and
how they expressed these key ideas. The following seeks to demonstrate the basic settings regulations that currently govern the Brazilian higher education, intending to demonstrate that contemporary legal reality holds with peculiar variations, the materialization of those aspirations. For ultimate concludes with a brief reflection on the current need for a specific course of graduation for public officials in general, bringing some of the features that their pedagogical could assume.
