O direito de saber a nossa história: identidade genética e dignidade humana na concepção da bioconstituição

Abstract

A identidade genética corresponde à dimensão da individualidade biológica do indivíduo, ao genoma de cada ser humano. Logo, é sinônimo de individualidade genética. O direito à identidade genética surge como um bem jurídico fundamental, portanto, objeto de proteção constitucional. Os avanços da engenharia genética provocam o despertar de uma nova concepção de Direito Constitucional, uma vez que afeta diretamente o significado das expressões “direitos fundamentais” e “dignidade da pessoa humana”, gerando ainda consequências no direito de filiação. A partir de tal perspectiva, desponta a Bioconstituição como um conjunto de normas com base na tutela da vida, na identidade e integridade das pessoas, a qual é introduzida no ordenamento jurídico frente às inovações trazidas pela Bioética e pelo Biodireito. Em decorrência, por meio de análises argumentativas, busca-se aprofundar o estudo acerca da consagração de um direito à identidade genética sob o perfil jurídico constitucional.

Genetic identity is the dimension of biological individuality, the genome of every human being. Thus, it is synonymous with genetic individuality. The right to genetic identity emerges as a fundamental legal property; therefore, it is object of constitutional protection. Advances in genetic engineering lead to the awakening of a new conception of Constitutional Law, since it affects directly the meaning of the terms "fundamental rights" and "human dignity", generating consequences in law of parentage. From this perspective, the Bioconstituição comes out as a set of rules that are based on protection of life, identity and integrity of persons, which is introduced in the legal set in relation to the innovations brought by Bioethics and Biolaw. As a result, by means of argumentative analysis, we seek to deepen the study of the consecration of a right to genetic identity under the legal and constitutional profile.
