Os desafios da proteção jurisdicional dos direitos sociais, econômicos e culturais

Abstract

A incorporação dos direitos sociais, econômicos e culturais nos textos constitucionais teve como objetivo lhes oferecer uma efetiva garantia constitucional. A natureza particular destes direitos está a exigir um tratamento jurisdicional diferenciado dos direitos civis e políticos: o tratamento individualista das ações constitucionais deve ceder diante das exigências de regulamentaçõ legislativa dos direitos constitucionalmente protegidos e, sobretudo, diante do perfil transindividual dos novos direitos fundamentais.

The incorporation of the social, economical and cultural rights to the constitutional texts had as its aim to offer an effective constitutional guarantee. The private nature of these rights, is requiring a diffenciated jurisdictional treatment of the civil and political rights: the individualist treatment of the constitutional action must yield to the exigencies of the legislaive regulation of the constitutionally protected and, above all, the transindividual profile of the new primordial rights.
