Abstract:
O presente artigo pretende analisar historicamente os aspectos mais relevantes na contrução do Direito nacional brasileiro, tais como a influencia do liberalismo, a herança pombalina, a criação das primeiras escolas de Direito, bem como a legislação do período. A partir da independência do Brasil em 1822 foi necessária a formação de uma cultura jurídica nacional, onde o principal protagonista longe de ser o povo foi a elite imperial. O que marca esse período foi a fundação das primeiras escolas de Direito com a consequente criação de uma elite jurídica brasileira e a consolidação de um arcabouço legal positivo. A doutrina do liberalismo inspirou todo esse movimento com especificidades aplicadas a situação política e econômica do país.
This article aims to analyze historically the most important aspects in the construction of the Brazilian national law, such as the influence of liberalism, inheritance Pombal, the creation of the first schools of law, and the legislation of the period. From the independence of Brazil in 1822 required the formation of a national legal culture, in which the main character far from the people was the imperial elite. What marks this period was the founding of the first law schools with the consequent creation of an elite Brazilian legal and consolidation of a positive legal framework. The doctrine of liberalism inspired this whole movement with specifics applied to political and economic situation of the country.
