Abstract:
O presente trabalho tem como fundamento discorrer em torno da fundamentalidade constitucional do Meio Ambiente, sustentado, necessariamente, sob a égide da hermenêutica do Art. 225 da Constituição da República Federativa do Brasil. Também, remeter-se-á à condição da tratativa do Estado de Direito Democrático com vistas à fruição de um Estado ideologicamente, socialmente e juridicamente ambiental (Estado de Direito Ambiental), alicerçado na promoção e na garantia da Justiça Ambiental como fundamento de execução da proteção contra a ocorrência de danos ambientais que, essencialmente, é destinada aos mais estigmatizados e vulneráveis do sistema capitalista que – originariamente – remete à idealização do risco inerente à própria condição.
This work is based discoursing about the constitutional fundamentality of Environment, supported, necessarily, under the aegis of the hermeneutics of Article 225 of the Constitution of the Federative Republic of Brazil. Also, it will refer to the condition of the dealings of the Rule of Law with a view to the enjoyment of a state ideologically, socially and legally environmental (State Environmental Law), founded in promoting and ensuring environmental justice as the foundation for implementing protection against environmental damage that essentially is designed to the most vulnerable and stigmatized the capitalist system - originally - refers to the idealization of the risk inherent in the condition.
