Abstract:
O tema da justiça esta presente na tradição jusfilósofica desde o pensamento clássico até o contemporâneo. Nesse sentido, termos como igualdade e diferença, foram conceituados de maneiras diversas através dos tempos, sendo, atualmente, compreendidos conjuntamente. O Estado social de Direito assume o compromisso de promover a igualdade material. As ações afirmativas são políticas públicas de discriminação positiva,que sinalizam para uma dupla função: reparadora e redistributiva.O trabalho parte do pressuposto de que esse instituto, surgido no direito norte-americano, se expressa diferentemente em cada sociedade o que exigiria um aprofundamento dos diferentes argumentos que justificam a criação de políticas de ação afirmativa para negros e para indígenas, particularmente no acesso às instituições de ensino superior. Nessa perspectiva, pode-se traçar um panorama da justiça social no Brasil. A igualdade substantiva é uma meta a ser atingida pela ação conjunta do poder público e da sociedade, repercutindo na efetividade dos direitos humanos.
The justice theme is present in the legal and philosophical tradition from the classical to the contemporary thought. In that sense, terms as equality and difference received diverse concepts throughout time and are nowadays understood collectively. The social State of Law has the role of promoting material equality. The affirmative actions are public policies of positive discrimination, which refer to a dual function of repairing and redistributing. This study is based on the idea that this institute, originated in the North-American law, is manifested differently in each society, which would demand a deeper analysis of distinct arguments that justify the creation of affirmative action policies for Afro-descendants and aboriginals, especially regarding the access to third degree institutions. Based on that, a view of social justice in Brazil can be constructed. Substantive equality is a goal to be achieved collectively by the government and the society, resulting in the effectiveness of human rights.
