Reparação extrapatrimonial dos danos ambientais à luz da Teoria da Complexidade de Edgar Morin

Abstract

Pela teoria da reparação integral, verifica-se que o dano ao meio ambiente deve ser reparado tanto na esfera material quanto na esfera extrapatrimonial (constituída por valores primordiais, como o bem-estar, o direito à vida, à saúde, à dignidade, etc). Todavia, quanto ao segundo ponto, surge uma indagação: esses valores, quando atingidos, merecem proteção jurídica? O ordenamento jurídico brasileiro recepcionou a tese do dano extrapatrimonial ambiental? Neste sentido, o trabalho propõe uma reflexão acerca da legislação e jurisprudência nacionais, tendo como referencial teórico a Teoria da Complexidade de Edgar Morin.

By the theory of integral reparation, it verifies that the damage caused to the environment must be repaired in the material sphere as much as in the moral sphere (constituted by primordial values, like well-being, the human dignity, the right to live and to health, etc). In the second point, however, it appears a doubt: those values deserve juridical protection in view of a violation? The Brazilian Law accepts the theory of environment’s moral damage? Therefore, the article proposes a reflection concerning the national law and some juridical decisions, having in mind the Theory of Complexity developed by Edgar Morin.
