Abstract:
A cooperação jurídica, em matéria penal, vem crescendo nos últimos anos escudada na elaboração de tratados internacionais, constituição de organismos internos e surgimento de mecanismos para efetivar as medidas solicitadas. Ainda que a cooperação seja uma realidade no cotidiano deste século XXI, trata-se de um instituto novo em desenvolvimento, um campo que necessita uma análise de sua origem até as perspectivas atuais. O artigo examina os principais tratados que contemplam o tema, dando ênfase no contexto histórico que permitiu a criação destes instrumentos, que revolucionariam a cooperação jurídica internacional em matéria penal.
The legal cooperation in criminal matters has been growing in recent years based on the development of international treaties, constitution of internal bodies and the emergence of mechanisms to accomplish the requested action. Although cooperation is a reality in the 21st century, it is a developing new institution, field that requires an analysis of its origin until the current perspectives. The paper examines the main international treaties which contemplate the theme, emphasizing the historical context that led to the creation of these instruments, which would revolutionize the international legal cooperation in criminal matters.
