Abstract:
Este trabalho pretende apontar os limites dos Juizados Especiais
Federais, criados pela Lei nº 10.259/01, justamente para
aproximar a Justiça Federal da população e conceder aos
jurisdicionados uma rápida entrega dos bens tutelados, mormente
quando se tratam de direitos sociais fundamentais. Por outro lado,
estes Juizados vem se demonstrando ineficientes para dar conta
da complexidade que envolve os aspectos que compõem a perda
da capacidade laboral. Entendemos ser fundamental construir a
perícia biopsicossocial, à luz de novos conceitos e significados
trazidos pela International Classification of Functioning,
Disability and Health, denominada na língua portuguesa por
C.I.F. (Classificação Internacional de Funcionalidade,
Incapacidade e Saúde), de maio de 2001 e pela Convenção
Internacional sobre os Direitos das Pessoas com Deficiência, da
Organização das Nações Unidas (ONU). Entendemos que
somente essa mudança de paradigma poderá dar continuidade à ideia inicial motivadora e fundante dos Juizados Especiais
Federais, qual seja, o acesso à justiça de uma gama imensa de
trabalhadores e trabalhadoras desprovidos e desprotegidos de
seus direitos.
This study aims to point out the limits of Federal Special Courts,
created by Law No. 10.259/91 to approach the Federal Court of the
population and grant jurisdictional rapid delivery of protected goods,
especially when dealing with fundamental social rights. However,
these Courts have been inefficient to account for the complexity that
involves the aspects that make up the loss of work capacity. It is
essential to build the biopsychosocial expertise in the light of new
concepts and meanings brought by the International Classification of
Functioning, Disability and Health, from May 2001, and by the
International Convention on the Rights of Persons with Disabilities
of the United Nations (UN). Only this paradigm shift can continue
the motivating and founding initial idea of Special Courts Federal,
namely the access to justice for a huge range of workers who have
been deprived unprotected with regard to their rights.
