A licença-maternidade sob a luz da teoria da criança terceirizada

Abstract

O presente trabalho tem como objetivo desenvolver estudo sobre a importância do aumento do tempo de licença-maternidade, em razão da necessidade do recém-nascido em ter contato principalmente com a figura materna em tempo integral e a legislação brasileira vigente no momento. Para que o desenvolvimento de um bebê seja satisfatório é imprescindível a presença dos pais, de seu afeto e cuidado, além da amamentação nos primeiros anos de vida, portanto, desenvolve-se sobre a importância de tais contatos. Ainda, tendo em vista que as relações afetivas na atualidade estão muito conturbadas, já que muitas vezes se dá mais valor às conquistas materiais do que ao aperfeiçoamento dos vínculos individuais, inclusive com os filhos, disserta-se sobre a criança terceirizada, produto de uma sociedade extremamente consumista e, dessa forma, como consequência, apresenta-se as influências negativas no desenvolvimento físico, psicológico e imunológico que essa terceirização causa no infante. O estudo em questão também visa informar sobre os malefícios da separação precoce da mãe e do bebê e sobre os danos da institucionalização da criança antes do tempo ideal, para que se previna sequelas futuras indesejáveis e se garanta a proteção aos direitos da criança. E, expondo sobre a legislação brasileira atual quanto aos direitos da mãe e da criança, apresenta-se a proposta de defender a extensão do período do benefício licença-maternidade para o máximo de tempo possível, sendo o lapso ideal de até dois anos, tendo em vista a importância dos primeiros anos de idade da criança para o seu crescimento.

This paper aims to develop study on the relevance of increasing the maternityleave period, in face of the newborn need for full-time contact, especially withthe mother, and Brazil’s current law. For a satisfactory development of thebaby it is essential to have the parent’s presence, their affection and care, as well as breastfeeding in early life, therefore, the importance of these themes are discussed. Moreover, considering the troubled aspect of affective relations on modern days, and how people often give more value to material achievements than to the improvement of individual bonds, their own children included, this study focus on the outsourced child, a product of an extremely consumerist society and, therefore, as a result, develops about the negative influences that this practice has on the physical, psychological and immunological development of the infant. This study also aims to inform about the harmful effects of early separation of mother and child and the damages of early institutionalization of children, before ideal time, to prevent undesirable future consequences and ensuring the protection of children's rights. Thus, exposing current Brazilian legislation regarding the rights of mother and child, this paper proposes the extension of maternity leave benefit period for as long as possible, knowing that the ideal period is up to two years, and also acknowledging the importance of the early years on the child’s growth and development.
