Análise da organização dos tribunais no direito processual desportivo brasileiro

Abstract

O trabalho a seguir tem por objetivo analisar a estrutura da Justiça Desportiva Brasileira no âmbito do futebol. Inicialmente se analisa a legislação desportiva como um todo, através de três períodos históricos do país que culminaram na Constitucionalização e democratização do desporto. Demonstradas as razões pelas quais se construiu a legislação desportiva no decorrer dos anos, passa-se a análise mais detida da Justiça Desportiva, na busca por demonstrar de forma fundamentada, as razões pelas quais há a necessidade de revisão de alguns conceitos sobre a Justiça Desportiva do futebol brasileiro, onde se aponta em direção contrária à influência política e determinadas pessoas mantenham o poder que possuem. Ainda, nesse sentido, são apresentadas propostas de modificação a serem realizadas nesse órgão judicial, para que se possa prestar à Justiça Desportiva do futebol maior credibilidade nas decisões de seus auditores nas mais variadas instâncias desportivas competentes para a análise das lides desportivas. Ao final, conclui-se explanando sobre as possibilidades de renovação ventiladas que acabam por esbarrar na política estabelecida dentro do futebol nacional.

The following study aims to analyze the structure of the Brazilian Sports Justice in the context of soccer. Initially, it analyzes the sports legislation as a whole, through three historical periods of the country that culminated in Constitutionalisation and democratization of sport. Demonstrating the reasond why the sports legislation was built over the years and the motives of a necessity of a more detailed analysis of Sports Justice, it seeks to demonstrate in a reasoned manner, the reasons why it is necessary to review some concepts of Sports Justice in Brazilian soccer, where it goes trough the opposite direction about political and financial influence that some entities of Brazilian Soccer make use for certain people to keep the power they possess. Still, in this respect, the proposed modifications are presented to be held in this judicial body, so that we can provide to the soccer Sports Justice more credibility in the decisions of its auditors in various sports bodies responsible for the analysis of sports labor. Finally, the renewal-ventilated possibilities that end up bumping into the established policy within the national football are explained.
