Abstract:
O presente trabalho busca traçar a evolução histórica social no Brasil, mais especificamente da assistência social, a fim de, a partir disso, analisar a finalidade e a mais adequada forma de aplicação do Benefício de Prestação Continuada da Lei Orgânica de Assistência Social à luz da Constituição Federal de 1988. Ademais, questionará os critérios utilizados para sua concessão no âmbito administrativo e judicial, incluindo nesse segundo uma análise sobre o (des)valor da discricionariedade judicial na aplicação de políticas públicas no Brasil.
This paper traces the social historical development in Brazil, more specifically the social assistance in order to, then, examine the purpose and the most appropriate form of implementation of the Continuous Cash Benefit of the Organic Social Assistance Law through the perspective of the Constitution of 1988. In addition it will question the criteria used for granting the administrative and legal framework, including that according to an analysis of the (dis)value of judicial discretionarity in the application of public policies in Brazil.
