Abstract:
O presente trabalho, destinado à conclusão do curso de Direito da Faculdade de Direito da Universidade Federal do Rio Grande, intitulado “O Instituto da
Desaposentação e o Sistema Previdenciário Brasileiro”, compõe-se de três capítulos. Inicialmente, abordar-se-á a definição de Previdência Social, elucidando seu caráter na atual Constituição Federal, bem como, será realizada uma leitura histórica e pontual da Previdência Social no ordenamento jurídico pátrio, o que evidenciará a gradual formação e estabilização de seus benefícios. Por conseguinte, explanar-se-á brevemente acerca dos regimes previdenciários do sistema brasileiro, em especial do Regime Geral e suas respectivas espécies de aposentadoria. Ainda, discorrer-se-á sobre o instituto da desaposentação, analisando suas especificidades e principais argumentos doutrinários favoráveis e contrários à sua concessão. Por fim, será enunciada a posição majoritária dos tribunais inferiores e superiores, que poderão influenciar os rumos do instituto em epígrafe. Para discorrer em prol do tema, em função dos objetivos mencionados, irá se tratar de pesquisa teórica constitucional e infraconstitucional, objetivada a partir de fontes primárias, ou seja, pesquisa doutrinária e legal. Em complemento, recorrer-se-á à jurisprudência brasileira atual, de modo a sondar o tema, também, sob um viés prático.
This work, for the completion of the Law course at the Faculty of Law at the Federal University of Rio Grande, titled "The Institute of Desaposentação and the Brazilian Social Insurance System", consists of three chapters. Initially, it will address the definition of Social Insurance, elucidating its character in the Federal Constitution, as well as, it will be performed a historical and timely reading of Social Insurance in our national laws, which will reveal the gradual formation and stabilization of its benefits Therefore, it will briefly explain the insurance regimes of the Brazilian system, particularly the General Regime and its respective species of retirement. Still, it will be discussed about the institute of desaposentação, analyzing its specificities and main pros and cons doctrinal arguments. Finally, it will be stated the majority position of the lower and higher courts, which may influence the direction of the institute in question. To expound on behalf of the subject, according to the goals mentioned, it will be dealt with constitutional and infraconstitutional research, objectified from primary sources, in other words, doctrinal and legal research. In addition, the current Brazilian jurisprudence shall be referred, to probe the subject, also, under a practical bias.
