A (in) eficácia da medida coercitiva de prisão ao devedor de alimentos

Abstract

O presente trabalho tem por temática a eficácia da prisão do devedor de alimentos,

delineada inclusive pela ótica do executado. Para a elucidação do assunto, utilizar-se-á, como

metodologia de pesquisa, revisão bibliográfica e análise de jurisprudências pertinentes ao

tema. Traz o estudo da evolução dos alimentos através do direito romano e brasileiro, o

conceito de alimentos naturais e civis e definitivos e provisórios, bem como os alimentos no

contexto do direito de família. Na sequencia, faz-se uma análise do conceito de execução,

seus princípios norteadores e a evolução dos meios de coerção ao longo da história. Adiante

traça-se um panorama do sistema legal brasileiro atinente à matéria e adentra ao tema central

do trabalho trazendo posições doutrinárias e análises principalmente de jurisprudências do

Tribunal de Justiça do Rio Grande do Sul, Superior Tribunal de Justiça e Supremo Tribunal

Federal. Por fim aborda-se as alterações e mudanças do novo Código de Processo Civil no

que tange a execução de alimentos e reflete-se acerca da (in) eficácia da prisão do devedor de

alimentos como meio de coerção face à dívida de alimentos.

This work is subject to effectiveness of the arrest of the maintenance debtor,

including outlined the perspective of the run. For the elucidation of the subject, will be used

as research methodology, literature review and analysis of case law relevant to the topic.

Brings the study of the evolution of food through the Roman and Brazilian law, the concept of

natural and civil, definitive and provisional food as well as food in the context of family law.

In sequence, it is an analysis of the concept of implementation, its guiding principles and the

development of means of coercion throughout history. Forward draws up an overview of the

Brazilian legal system regards the matter and enters the central theme of work bringing

doctrinal positions and analyzes mainly from case law of the Court of Justice of Rio Grande

do Sul, Superior Court and Supreme Court. Finally we discuss the alterations and changes of

the new Code of Civil Procedure regarding the implementation of food and is reflected on the

(in) effectiveness of the maintenance debtor's prison as a means of coercion against the debt

foods.
