Abstract:
O presente trabalho será realizado na área do Direito infracional juvenil, objetivando-se discorrer sobre o caráter punitivo da medida socioeducativa aplicada a adolescente em conflito com a lei. Visando tal finalidade, a pesquisa abordará aspectos gerais e conceituais da área acima referida, por meio de pesquisa doutrinária e jurisprudencial. Além disso, tem como propósito realizar uma análise crítica acerca do atual sistema penal juvenil, o qual se revela ineficaz perante o cenário nacional moderno, bem como assinalar as discrepâncias legais e procedimentais em face dos direitos e garantias assegurados a indivíduos maiores de dezoito anos de idade.
This work will be done in the area of juvenile law infraction. It is aiming to discuss the punitive character of socio-educational measures applied to adolescents in conflict with the law. Aiming at such a purpose, the search address general and conceptual aspects of the above area by judicial doctrine and research. Also, it aims to critically about the current juvenile justice system analysis which is not effective to the national scene in modernity, as well as point out the legal and procedural discrepancies in the face of the rights and guarantees provided to individuals over eighteen.
