Abstract:
Apesar de o processo penal em um Estado Democrático de Direito dever estar
compromissado com a Constituição, assumindo o papel de verdadeira garantia do acusado diante de possíveis abusos do poder punitivo estatal, observa-se que o sistema processual pátrio acaba por consagrar a lógica inquisitória, produzindo um magistrado com fortes tendências autoritárias, altamente atentatórias à esfera de garantias do acusado. Diante da incompatibilidade constitucional dessa tendência violadora, torna-se essencial que o juiz negue a lógica inquisitória, transcendendo também o princípio dispositivo que consagra a lógica acusatória, sendo, portanto, o horizonte norteador dessa necessária postura democrática o objeto a ser analisado no presente estudo, através de pesquisa bibliográfica.
Even though the criminal proceedings of a Democratic State of Law should be
committed to the Constitution, assuming the role of a true guarantee for the accused when faced with possible abuses of the State’s punitive power, it is noticeable that the nation’s procedural system ends up consecrating the inquisitorial logic, therefore producing a magistrate that possess Strong authoritarian tendencies, wich are in disaccord with the accused guarantees. Faced with the costitutional incompatibility of this violating tendency, it becomes essential for the judge to deny the inquisitorial logic and transcend the principle’s device that consecrates the accusatorial logic, therefore making this needed democratic stance the guiding horizon to be analyzed in this study, through bibliographic research.
