Abstract:
A violência contra a mulher é um fenômeno social com grande visibilidade nos últimos anos, em todo o mundo. Considerando as consequências para a saúde e a violação dos direitos e a dignidade das mulheres, as políticas públicas passaram a ser buscadas por diversos setores da sociedade. O surgimento da Lei 11.340 de 07 de agosto de 2006 tornou crime a violência doméstica e familiar e os atos de agressões cometidos contra as mulheres. Através desta lei, aumentaram as punições e o aumento do número de denúncias por parte das vítimas. Tendo em vista que a lei Maria da Penha é de suma importância e considerada um avanço para o nosso ordenamento jurídico, beneficiando inúmeras vítimas, o presente trabalho irá analisar quais os benefícios que a lei trás para as vítimas, mas também, as formas que ela é mal utilizada. Estas mulheres que de alguma forma, através de falsas acusações, buscam prejudicar homens com os quais estão disputando pensões alimentícias, bens e guarda de filhos. Além disso, existem indagações sobre a aplicabilidade da lei e sua eficácia, quando a vítima após reconciliar-se com o agressor, manifesta desinteresse no prosseguimento do feito, o que acaba ocorrendo é que muitas mulheres não conseguem sustentar o interesse em ver seu companheiro processado, preferindo manter um relacionamento, mesmo com histórico de violência, o que evidencia o sentimento de dependência e inferioridade das mulheres em relação aos seus agressores. Através de falsas acusações e casos de reconciliações (com descumprimento de medidas protetivas) ocorre uma perda da efetiva utilização da lei, bem como diminui o valor da denúncia das vítimas que realmente precisam desta lei.

Through false accusations and cases of reconciliation (with noncompliance with protective measures) there is a loss of the effective use of the law, as well as diminishing the value of the denunciation of the victims who really need this law.
