Abstract:
O ato de migrar é inerente à condição humana, que assim como na natureza, é sinônimo de
busca por algo novo, algo que não se pode encontrar no lugar em que se está. Procurar entender
como as migrações internacionais impactaram a formação do Brasil e seu cenário sociocultural
e jurídico é o tema proposto neste trabalho, a partir do estudo do histórico do fluxo imigratório
no cenário brasileiro desde o seu “descobrimento” no século XVI, passando pelo período
Imperial até a chegada da era republicana – desde a sua implementação no território até os dias
atuais. Para dialogar com o histórico migratório, será feita a análise das políticas imigratórias
brasileiras em cada período político pelo qual passamos, para entender quais eram as
dificuldades enfrentadas pelos imigrantes em cada época em que aqui chegavam. Será feito,
também, o estudo do perfil do imigrante no panorama contemporâneo brasileiro, por meio de
pesquisa qualitativa e quantitativa, na tentativa de verificar se há um padrão imigratório em
nossa nação. Por fim, será analisado o processo de integração dos imigrantes e suas dificuldades
no acesso a serviços, direitos e políticas públicas no Brasil à luz do art. 5º, caput, da
Constituição Federal de 1988, para verificar se há ou não um efetivo aparato estatal que
possibilite além do processo de estadia do imigrante, o processo de acolhimento em nosso solo
através da efetivação de políticas públicas que garantam a promoção do tratamento igualitário
e da justiça social prevista em nossa Constituição Federal atual
The act of migrating is inherent in the human condition, that just as in nature, is synonymous
with search for something new, something you can not find in the place where you are. Seek to
understand how international migration impacted the formation of Brazil and its socio-cultural
and legal scenario is the theme proposed in this paper, from the history of the immigration flow
study in the Brazilian scene since its "discovery" in the sixteenth century, through the Imperial
period until the arrival of the Republican era - since its implementation in the territory to the
present day. To dialogue with the migratory history, analysis of the Brazilian immigration
policy will be made in each political period we went through, to understand what were the
difficulties faced by immigrants in each time when arrived here. Will be also study the
immigrant profile in the Brazilian contemporary scene, through qualitative and quantitative
research in an attempt to check if there is a migratory pattern in our nation. Finally, it analyzed
the process of integration of immigrants and their difficulties in accessing services, rights and
public policy in Brazil in the light of art. 5, caput, of the 1988 Federal Constitution, to check
whether or not an effective state apparatus that enables besides the stay process of immigrant
the process of welcomed in our contry through the effective implementation of public policies
to ensure the promotion of equal treatment and social justice foreseen in our Federal
Constitution.
