Abstract:
O presente trabalho monográfico busca analisar o trabalhador rural com seus
direitos perante as leis brasileira, quanto aos elementos que constituem este trabalho
que é de grande importância para a economia do nosso País. Traz a opinião de
doutrinadores e da jurisprudência atual, referentes a aposentadoria especial do
trabalhador rural. Avalia casos em que foi aceita ou não insalubridade decorrentes da
exposição do trabalhador a altas temperaturas provocadas pelo calor e radiação solar.
Por conseguinte, mostra o avanço do assunto perante os tribunais brasileiros acerca do
Direito do Trabalho e do Direito Previdenciário. Por fim, analisa a legislação do país
que, ainda hoje, se omite ou negligencia esse tipo de benefício ao trabalhador rural.
This monograph analyzes the rural workers with their rights under Brazilian
laws concerning the elements that comprise this work is of great importance for the
economy of our country. Brings opinion of scholars and current case law regarding
special retirement of rural workers. Evaluates cases in which it was accepted or not
arising unhealthiness of worker exposure to high temperatures caused by heat and solar
radiation. Therefore shows the progress of the matter before the Brazilians about the
Labour Law and Social Security Law courts. Finally, it analyzes the law of the country
that even today, omits or neglects this kind of benefit to the rural worker.
