O princípio da efetividade e a multiparentalidade no direito de família brasileiro

Abstract

Família.O presente trabalho, destinado à conclusão do curso de Direito da Faculdade de Direito da Universidade Federal do Rio Grande, intitulado “O Princípio da Afetividade e a Multiparentalidade no Direito de Família Brasileiro” fundamenta-se a partir da análise de todos os textos constitucionais que vigeram no país, com especial atenção à Constituição Federal de 1988, a qual, ao proteger a pluralidade familiar, promoveu uma enorme mudança na forma como o Direito, até então, tratava das relações familiares. Também a partir da Carta de 1988 e a inclusão de inúmeros Princípios Constitucionais ao nosso ordenamento, buscou-se abordar o modo como tais princípios, em especial o Princípio da Afetividade, contribuíram para a efetivação da pluralidade das estruturas familiares, procurando evidenciar o papel do afeto e seu respectivo valor jurídico nessa nova perspectiva acerca da família. Como consequência de tal Princípio, surge a temática das estruturas familiares contemporâneas, entre elas, a família multiparental. Sobre essa estrutura familiar, explorou-se a possibilidade da coexistência de filiação biológica e afetiva, seus efeitos jurídicos e o modo como a jurisprudência vem tratando do tema. Para discorrer sobre os temas abordados, a metodologia utilizada baseou-se em pesquisa doutrinária e jurisprudencial.

The present work, intended for completion of Federal University of Rio Grande law school course, entitled “The affectivity principle and the multiple-parenting in Brazilian’s Family Law” is based on the analysis of all constitutional texts who become effective in the country, with special attention to the 1988’s Federal Constitution, which, while protecting the family plurality, promoted a large mutation in how the law, until then, treated family relationships. Also, because of the 1988’s Constitution and the inclusion of several Constitutional Principles to the Brazilian law, it was sought to approach the manner how these principles, in special the Affectivity Principle, contributed to the effectiveness of the family structures plurality, looking for evidencing the role of affection and it’s respective legal value in this new family perspective. Because of this Principle, arises the contemporary’s family structures theme among then, the multiple-parenting family. About this family structure, the possibility of a coexisting biological and affective filiation has been explored, it’s legal effects and the manner how the jurisprudence has been treating the subject. To discourse about the addressed themes, the methodology applied was doctrinal and jurisprudential research.
