Abstract:
Este artículo tiene como objetivo estudiar y analizar los
principales aspectos del derecho a vivir en un ambiente libre de
contaminación inscrito en la Constitución de Chile de 1980. Este
derecho se analiza desde la interconexión de dos puntos de vista, es decir, la simbiosis entre derecho a la vida y la contaminación
existente. El punto central de esta investigación perquire la
siguiente pregunta: ¿Es la protección del medio ambiente,
conservación de la naturaleza y la conservación del patrimonio
natural son compatibles con el derecho fundamental a vivir en un
ambiente libre de contaminación de medio ambiente. En este
sentido, el artículo llama la atención para lo hecho de que la
Constitución Chilena tiene un carácter individual con respecto al
derecho a un medio ambiente sano. Y que, debido a la diferencia
temporal entre el creación de la Constitución hasta los días
actuales, muchos de los principios de la justicia socioambiental
nao son utilizados pelo texto constitucional.
This article is intended to study the main aspects of the right to
live in a free of contamination environment according to chilean's
Constitution (1980). This right will be analyzed through the
interconnection of several points of view, in other words, the
symbiosis between the right to live and the existent
contamination. The main focus of this investigation is to evaluate
if the environment's protection, nature's conservation and the
natural patrimony's conservation are compatible with the
fundamental right to live in a free of contamination environment.
Therefore, the article emphasizes a very important aspect about
the chilean's Constitution that guarantees to everyone,
individually, the right to a healthy environment which due to the
temporal lapse between the constitutional development and the
present days, many aspects of environmental and social justice
are not used by the constitution.
