Abstract:
A presente pesquisa tem o objetivo de desconstruir os paradigmas sedimentados acerca do instituto da prisão preventiva. Para isso postulamos através da construção de Zaffaroni (Teoria Agnóstica ou negativa da pena), os mesmos fundamentos para denunciar as distorções práticas que em muito se distanciam daquilo que é previsto em lei. Frente a esse problema faz-se necessário voltar no tempo de forma pontual para demonstrar que o poder punitivo sempre encontrou uma justificativa para a concentração do poder através da força, por meio da prisão como eixo central de controle. Projetamos um horizonte agnóstico e negativo da prisão preventiva por entender que esta não se atende aos seus objetivos, servindo na prática como mais um mecanismo de controle, uma pena antecipada.
The present research aims to deconstruct established paradigms about the institute of pre-trial detention. So we postulate through the work of Zaffaroni on the Agnostic Theory or denial of the penalty, the same grounds to denounce the practical distortions that far distant from what is predicted in law. Towards this problem it is necessary to go back in time in a punctual way to show that the punitive power has always found a justification for the concentration of power through force, being imprisonment the central axis of its control. We project an agnostic and negative horizon of pre-trial detention because we understand that it does not meet its objectives, serving as another control mechanism, an anticipated penalty.
