Abstract:
Na busca pela realização da dignidade humana, o pressuposto hegemônico de que um Estado de Direito, com base em sua soberania, tem liberdade para barrar o ingresso de pessoas em seu território necessita ser melhor analisado. Para compreender como se dá a dialética entre a declarada proteção do direito positivo sobre o imigrante e a realidade das relações políticas, econômicas e jurídicas em que se envolve, propôs-se o estudo de caso da comunidade de imigrantes senegaleses no Rio Grande/RS. O objetivo geral da pesquisa foi o de conhecer, no âmbito deste fluxo migratório senegalês para a cidade do Rio Grande/RS, as manifestações do direito em suas vidas, as determinações que o direito lhes provoca, sempre tendo em vista o binômio trabalho - condição migratória. Buscou-se, portanto, problematizar o direito desde uma perspectiva sociológica. Num primeiro momento, realizou-se o estudo teórico acerca das relações entre Estado de Direito, migração e trabalho. Após, por meio de pesquisa empírica qualitativa delineada como estudo de caso, analisaram-se três dimensões especificas do ser imigrante: a condição migratória, a inserção no mercado de trabalho e ação política coletiva. O método utilizado foi o materialismo histórico e dialético, dentro de uma perspectiva jusfilosófica marxista. As técnicas utilizadas foram entrevistas semiestruturadas e observação direta. Como principais resultados, destacam-se a caracterização do imigrante senegalês no Rio Grande/RS como um sujeito periférico na periferia do capitalismo, que possui condição migratória regular, mas provisória, que é um trabalhador inserido no mercado de trabalho brasileiro, mas sofre com a superexploração do trabalho e que possui uma atuação política coletiva. Em função de tais resultados, pode-se concluir que ao mesmo tempo em que o Estado de Direito determina a vida do imigrante por meio da política e do direito, o imigrante estabelece formas de atuação em defesa de seus interesses. As principais recomendações que se apresentam dizem respeito à Associação dos Senegaleses do Rio Grande/RS, no sentido de que conclua sua formalização e amplie sua atuação para que instituições e projetos parceiros possam auxiliá-los na vida com dignidade.
In search for the achievement of human dignity, the hegemonic idea that a Nation-State, based on its sovereignty, has the power to stop people from entering its territory needs to be analised. In order to understand the dialectics between the declared protection by the law and the reality of political, economic and juridical relations involving immigrants, a case study of the immigrant Senegalese community in the city of Rio Grande/RS, is offered. The main goal of this research was to acknowledge the manifestations of law in the life of the immigrants, the determinations it causes, always taking in mind the relations between labour and migratory conditions. It aimed, therefore, to perform a sociological view over the law. First it was carried out a theorical study over the relations between four aspects that are involved in the international migration phenomena: Rule of Law, migration and labour. Then, using empirical qualitative research, this study also aimed to have better knowledge over the Senegalese migration flow to Rio Grande/RS in three specific dimensions of the immigrant being: migratory status, labor insertion and collective political action. In the methodological field, the dialectical and historical materialism was used, and the research was delineated as empirical qualitative research with the use of semi-structured interviews and direct observation. As main results of the research stands the characterization of the Senegalese immigrant in Rio Grande/RS as a peripheral being in the periphery of capitalism, which means he has a regular but temporary limited migratory status, he is a worker in the Brazilian labour market and therefore suffers the overexploitation of his labour force, and he acts in defense of his interests in a collective political dimension, represented by the Senegalese Association in Rio Grande/RS. In view of such, it may be seen that although the Rule of Law determines the life of immigrants with politics and legislation, the immigrants establish ways to act in defense of their interests. The strongest recommendation is made to the Senegalese Association in Rio Grande/RS, so that its formalization is completed and its actions increased, enabling partner institutions to develop more projects in order to help the associates in living a life with dignity, in the city of Rio Grande/RS.
