Abstract:
Esta dissertação foi produzida no Programa de Pós-Graduação em Direito e Justiça Social, na linha de pesquisa "A realização constitucional da solidariedade". A presente pesquisa tem como tema de investigação as uniões matrimoniais entre pessoas encarceradas na cidade de Rio Grande/RS. Assim como na sociedade extramuros, no cárcere as pessoas também têm direito a se relacionar. Vários são os motivos que podem ser elencados para que indivíduos resolvam estabelecer uma relação entre si, especialmente quando se trata de uma relação matrimonial. No espaço prisional, devido as especificidades do ambiente, como a dificuldade de contato físico entre as pessoas, tempos regrados para o desenvolvimento das atividades devido a organização da cadeia, acesso restrito a qualquer tipo de prazer e a ausência de pessoas de seu convívio familiar e afetivo, surgem diferentes motivos para que sejam formadas as uniões. Nesse sentido, a delimitação da temática foi realizada diante da incidência da formalização de matrimônios em um presídio misto, que comporta mulheres e homens na mesma estrutura arquitetônica. Diante disso, se propõe a responder à questão de pesquisa: por que as mulheres presas formalizam uniões matrimoniais com homens presos ou outras mulheres presas durante o cumprimento de pena? A pesquisa tem como objetivo principal compreender quais as razões para que as mulheres presas estabeleçam relações com presas/os que conheceram no sistema penitenciário da cidade de Rio Grande/RS e tem como objetivos específicos analisar como ocorre a aproximação entre as pessoas, o pedido de casamento, a rotina quando casadas/os e, por fim, o término ou a perspectiva de continuidade do matrimonio depois de conquistada a liberdade. A pesquisa está subsidiada pelo campo teórico feminista, bem como autoras/es que discutem a temática prisional. Para tanto, nos utilizaremos de autoras/es como Heleieth Saffioti, Carole Pateman, Olga Espinoza, Soraia da Rosa Mendes e Luiz Antônio Bogo Chies, Leni Beariz Correa Colares, dentre outras/os. A metodologia empregada é a investigação narrativa, na medida em que buscam construir dados a partir das entrevistas das mulheres encarceradas da Penitenciária Estadual do Rio Grande - PERG e para a análise dos dados o método adotado é o dialético. Dentre alguns resultados obtidos, destaca-se que carências materiais, necessidade de laços afetivos e também de proteção frente à instabilidade carcerária estão entre as razões apontadas por presas para estabelecerem relações no cárcere, motivos que seguem a lógica androcêntrica, condicionando as mulheres para uma sexualidade regulada pelo Estado.
This dissertation was produced in the Graduate Program in Law and Social Justice, in the research line "The constitutional realization of solidarity". The present research has as research theme the marital unions between people incarcerated in the city of Rio Grande / RS. Just as in society outside the walls, in prison people also have the right to relate. There are a number of reasons that can be listed for individuals to establish a relationship with one another, especially when it comes to a marriage relationship. In prisons, due to the specifics of the environment, such as the difficulty of physical contact between people, times regulated for the development of activities due to the organization of the chain, restricted access to any kind of pleasure and the absence of people from their family and different motives for forming the unions. In this sense, the delimitation of the thematic was carried out before the incidence of the formalization of marriages in a mixed prison, which includes women and men in the same architectural structure. In view of this, she proposes to answer the question of research: why do women prisoners formalize marriages with men arrested or other women imprisoned during their sentence? The main objective of the research is to understand the reasons for women prisoners to establish relationships with prisoners in the penitentiary system of the city of Rio Grande / RS. The specific objectives of this research are to analyze how people approach, the marriage, the routine when married, and, finally, the end or perspective of continuity of marriage after freedom has been won. The research is subsidized by the feminist theoretical field, as well as authors who discuss the prison topic. To do so, we will use authors such as Heleieth Saffioti, Carole Pateman, Olga Espinoza, Soraia da Rosa Mendes and Luiz Antônio Bogo Chies, Leni Beariz Correa Colares, among others. The methodology employed is narrative research, insofar as they seek to construct data from the interviews of women incarcerated at the State Penitentiary of Rio Grande - PERG and for the analysis of the data the method adopted is the dialectic. Among some of the results obtained, it is worth noting that material deprivation, the need for affective ties and also protection against prison instability are among the reasons pointed out by prisoners to establish relationships in the prison, reasons that follow the androcentric logic, conditioning women for sexuality regulated by the State.
